RJ Prime Investments Limited were issued a $3,000 fine in the Hamilton District Court on Friday for allowing a migrant worker to work in breach of their visa conditions.
Jagmeet Singh and Ranjeet Singh, Directors of RJ Prime Investments were fined for allowing a migrant to work at Beach Pizza, a takeaway shop in Hamilton which was not where the migrant’s visa permitted them to work and in breach of the migrant’s visa conditions. The migrant in question’s visa conditions stated they worked for Vape n Chill Limited, where Jagmeet and Ranjeet are also listed as Directors.
This is the first infringement notice that has been defended before the courts since the infringement enforcement tool under the Worker Protection (Migrant and Other Employees) Act was launched in April 2024. This is because RJ Prime Limited disputed the offence outlined in the infringement notice and they sought a hearing in the District Court for the matter to be defended.
Steve Watson, General Manager Immigration Compliance and Investigations said, “the infringement scheme allows our compliance officers and investigators to issue infringement notices to both accredited and non-accredited employers who commit low level offences, including allowing a migrant worker to work in a role that is not in that migrant’s visa conditions”.
“We are committed to ensuring employers are meeting their obligations when hiring migrants, and the infringement scheme allows us to penalise employers who are not meeting those obligations” says Steve.
There were 121 infringement notices issued to 118 employers, leading to a total of NZD $363,000 in penalties in the first year of the scheme.
RJ Prime Investments Limited are now on the employer stand down list and are unable to hire migrant workers.
